Which Form of Bankruptcy Is Right for You?

Most consumers file for one of two forms of bankruptcy: Chapter 7 or Chapter 13. Under Chapter 7 bankruptcy, your debts can be completely discharged with one court order. Under Chapter 13, your debts are combined into a monthly payment that you have to make consistently for three to five years.

For most consumers, Chapter 7 bankruptcy is preferable to Chapter 13. However, not all are eligible for Chapter 7. Our attorneys have had a significant amount of success helping clients file for Chapter 7 when Chapter 13 had previously looked inevitable. We have also helped clients transfer a bankruptcy from Chapter 13 to Chapter 7 when events significantly changed their economic circumstances.

File for Bankruptcy Before You Endanger Your Retirement

Too many individuals view bankruptcy as a last resort rather than a right afforded to them by the Federal Government. Too often, clients come through our doors after sacrificing their savings, 401(k), 403(b) and pension accounts to pay for a debt that could not be controlled. Bankruptcy is a tool you can use to protect your retirement funds. Don't use your retirement funds to avoid bankruptcy.

Immediate Debt Relief Today

If you retain our firm to handle your bankruptcy, you will experience immediate relief from your creditors. As your representatives, we will deal with them on your behalf. You will no longer receive harassing phone calls or past due notices.

In addition, when you file for bankruptcy, the Bankruptcy Court will immediately issue an "automatic stay," an order that prevents your creditors from taking any official action against you. This will halt the foreclosure process and lift any garnishments your creditors may have imposed upon your wages.

If you would like to schedule a free initial consultation to discuss your rights and options with a lawyer at Salinger and Associates, call us today at 248-569-5120 or contact us online. We look forward to hearing from you.
